Hello,
To be qualified for Homestead exemption, home owners need to own and occupy their homes on Jan 1st. Was that changed? Some settlement agency told me that currently, you can apply whenever, and county would honor you homestead exemption whenever they receive your application, is that right?
thanks

Addtional Details:
  • So, home buyers can file for HS exemption anytime after closing. But, can home buyers be granted HS exemption they are buying for the year they are buying? or, they are simply applying for next year, b/c they are not occupying the property on the 1st of Jan of the year they are buying. Right? So, to be granted HS, you still need to own and live starting on the 1st, please correct me if I am wrong. - Apr 26, 2022

Yes, that is a new rule change. They can file as soon as they close but only after they've changed their DL to match their new home address.

Initially you would've had to wait until Jan 1 (the year after you purchased your home) to file for your homestead exemption but Effective Jan 1, 2022 thanks to Senate Bill 8, one can now file for HS exemption at any time. Once transaction has been recorded and the appraisal district has changed ownership the exemption will apply. Be sure to call the appraisal district if ownership has not changed and inform them of ownership change, as sometimes this is not done automatically. Homestead property tax exemption can be claimed on Form 50-114.

It is awesome this year and after that the Homestead can be file any time of the year after closing. If you are in Harris County, you can file it in a couple minutes by going to hcad.org, or download it's App after the buyer has their ID/DL updated to match HS address. It is quick at your fingertips.

Yes sir. Anytime. After they close, it takes a couple days for the deed to be recorded, and then, they can file.

The DL address has to match the property address. It can all be done online in a matter of minutes.

Yes, it has changed. Effective Jan 1, 2022 a homeowner can file for HS exemption anytime. Before a buyer had to wait until Jan 1st of the year AFTER purchase but now they can do so immediately upon verification of the ownership name change in CAD records. EX: buyer closes on June 1, 2022. HS exemption can be filed anytime after closing. It’s best for them to verify it a few days after closing to ensure the property ownership is now in their name & their identification matches the address. In most counties the appraisal district info can be verified online as well as filing for HS exemption. This is a fantastic change!! There’s reduced chance of buyer forgetting to file for exemption
