If you have asked your realtor several times to remove your listing from H.A.R. and MLS and it is still listed weeks later, what are your remedies?

Listing is best terminated by executed termination of listing agreement. Talk to realtor or their brokerage. Realtors often gets sellers representation signed by sellers before listing a home and they can terminate it if mutually agreed.

Assuming there is a written listing agreement, there must also be a written termination agreement signed by the listing agent and seller. If the listing agent is unwilling to do this, I would recommend contacting that agent's broker.

Hi Stephen, if you have directed your Realtor to remove it and she has not done so, that's unacceptable! your next move is to speak with her office manager. I really hope your agent has given you a good reason why it has not been removed.

The above answers are excellent. Hopefully your situation has been resolved. Contracts are usually not fun or exciting to read over, but it's very prudent to read them completely to have an understanding of your property.

Hi Stephen,
I would agree to contact the agent's broker. The broker may not be willing to terminate the listing if you are still under contract with a current listing agreement. A listing agreement is a contractual agreement. You should be able to have them 'withdraw' it from MLS/HAR but you will not be able to list with another broker unless the broker releases you from the contract by signing a termination or until the listing agreement expires. If the listing is 'withdrawn,' it is still listed but not being marketed on MLS/HAR. I hope that helps.

I would agree with those commenting above. Talk to the Agent, preferably in writing. Escalate to the Broker, again in writing. If you are terminating the listing all together, there is a "Termination of listing" which should be filled out and signed by both you and the agent. If you are temporarily removing the home from the MLS, you would want to fill out an amendment to the listing, again in which both parties sign. The listing agreement itself, is a binding contract between you and your listing agents brokerage. In the event that either you or the agent want to alter or terminate the contract, it does require mutual agreement from both parties.
Lastly, Is your home active on HAR or other sites? HAR is the local MLS, a home that is listed or unlisted here automatically goes out to many other sites such as Zillow and Realtor etc. Some of these sites are slower to update than others. HAR updates within 15 minutes, other sites may take a week or two to generate updated information.

If your listing has not reached the expiration date contained in your Listing Agreement contract, then the Broker is not obligated to terminate the listing. However, the vast majority of brokerages will honor a home seller's request to terminate the listing earlier than the specified expiration date on the Listing Agreement. Definitely arrange to speak with the Broker-Owner or manager of the office to express your concerns and request to sign a Termination of Listing form. It's a one page form. I hope this helps. You will want to contact their broker as the listing belongs to the brokerage. In addition you will want to get a termination of listing agreement signed by the broker and yourself.

Hi Stephen,

If your wish was to terminate the listing and it's still listed as Active, I would recommend that you call the agent's broker immediately. Also, if you are terminating the listing, it's always best to do it in writing as well. The agent should send you a contract termination form to sign.
