That will be something that should clearly be taken care of when writing up the contract. The seller should disclose how much in deposits he has.

It's best to consult with a real estate attorney regarding this. But it's important to review the builder contract in full detail before signing off on it. There seems to be much more to the story here.

Is it legal to have a residence home listed for lease on MLS?


Yes, it's legal to list the home even if they don't technically have it as an investment. Just ask them if there is anything in their mortgage that prevents them from leasing the home out.Posted 12 years ago

Owner occupants with good credit should expect a rate of under 4% right now for a 30 year note. But if you are an investors, or your credit is bad, expect to pay more than that.
